Terms of Service
These terms are an agreement between you and TIKAALIK AI LABS INC. ("we", "us"), a company registered in British Columbia, Canada, and govern your use of the OfferShark desktop application and the offershark.ai website (together, the "Service"). By creating an account or using the Service you accept these terms.
1. The Service
OfferShark is a real-time AI assistant for remote interviews, case studies, and high-stakes meetings. It transcribes system audio, can read your screen when you ask it to, and streams AI-generated suggestions to an overlay window on your machine. The Service depends on third-party speech-to-text and AI model providers and requires an internet connection.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for your account credentials and for all activity under your account.
- Accounts are personal. Sharing, reselling, or transferring an account is not permitted.
3. Sessions, credits, and subscriptions
- The Service is sold as a free trial, one-time session packs, and a monthly subscription. Current pricing is shown at offershark.ai/#pricing and in the app.
- Payments are processed by Stripe. Prices are in Canadian dollars unless stated otherwise, and applicable taxes may be added.
- Subscriptions renew automatically each month until cancelled. You can cancel anytime from the app (Manage billing); cancellation takes effect at the end of the current billing period.
- Session credits from packs do not expire while your account is active but are non-transferable.
4. Refunds
If something went wrong — a session failed, a duplicate charge, a purchase you didn't intend — email support@offershark.ai within 14 days of the charge and we will make it right. Refunds for used sessions or partially used subscription periods are at our reasonable discretion. Nothing in this section limits refund rights you have under applicable consumer-protection law.
5. Acceptable use
Your use of the Service must comply with our Acceptable Use Policy, which is part of these terms. In particular, you are solely responsible for making sure your use of the Service is lawful in your jurisdiction and consistent with any agreements, policies, or rules that bind you (for example employment agreements, exam or certification rules, and consent requirements for capturing conversations).
6. Intellectual property
We own the Service, including the apps, site, and branding. You keep whatever rights you have in the content you provide (your resume, your words). AI-generated suggestions are provided for your personal use; we claim no ownership over what you do with them.
7. Disclaimers
The Service is provided "as is". AI output can be wrong, incomplete, or inappropriate for your situation — treat it as a suggestion, not advice, and verify anything you rely on. We do not guarantee transcription accuracy, uninterrupted availability, compatibility with any particular meeting software, or any outcome (including that you will receive an offer).
8. Limitation of liability
To the maximum extent permitted by law, TIKAALIK AI LABS INC. is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, opportunities, or data arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Termination
You can stop using the Service and request account deletion at any time. We may suspend or terminate accounts that violate these terms or the Acceptable Use Policy; where practical we will notify you and, for violations that are curable, give you a chance to fix them.
10. Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Courts located in British Columbia have exclusive jurisdiction, except where applicable consumer law gives you the right to proceed elsewhere.
11. Changes
We may update these terms as the Service evolves. For material changes we will update this page and note the new effective date; continued use after a change means you accept the updated terms.
